Ms. Susan Hozak is the authorized, official Publisher of Midwest Nest magazine. Midwest Nest Magazine shall not be responsible for errors in any advertisement due to errors in ad copy or artwork furnished by the advertiser. In the event of any error in any advertisement not caused by errors in ad copy or artwork furnished by the advertiser, the liability of The Publisher shall be limited to the return of any charges paid by the advertiser to The Publisher.
GENERAL POLICY
Advertisers and agencies representing the advertiser assume liability for all ad contents, text, photos, illustrations, representations,
and advertisements printed, and also assume responsibility for any claims arising there from made against the publisher or Midwest
Nest Magazine. The Publisher reserves the right to reject any advertising which is not in keeping with the publication’s standards.
Midwest Nest Magazine reserves the right to repeat previous copy if new copy is not received by the space reservation deadline
specified on the contract. Artwork will only be returned if so requested.
The advertiser agrees to honor any offers specified in its advertisement as per its terms and conditions. The advertiser assumes full
responsibility that advertiser’s advertisement, business operations, services and products comply with all applicable laws.
All Advertisements are accepted on the basis that they will be paid for at the applicable rates set out in the applicable rate card on the date of publication. Midwest Nest Magazine may change its rates at any time by publishing the modified rates at midwestnestmagazine.com. Any changes to the rates will take effect immediately. However, any changes to the applicable rates will not apply to any orders made prior to the date of such change. Midwest Nest reserves the right to modify the regional distribution routes and production of printed copies, such as increasing the printed copies for use at events, or reasonably decreasing due to unforeseen health concerns/environmental circumstances or disruptions of the usual routes.

CANCELLATION POLICY
As a general policy, Midwest Nest Magazine will not allow cancellations on the signed/agreed upon contract with the Advertiser or representing Agency. If the Advertiser or Agency has a financial circumstance deemed beyond their control, Midwest Nest Magazine must receive a 30 day notice via phone call, written cancellation request via email or mail with notice that the Advertiser is insolvent or bankrupt or is otherwise in breach of these Terms. If the cancellation request on purchased advertising is received after the deadline, we cannot cancel the insertion.
MOVING SCHEDULED ADVERTISEMENTS
In the event a contracted advertisement needs to be delayed or rescheduled to another publication date, Advertisers and Agencies
will need to give email or phone call notice to Midwest Nest Magazine before 12:00a.m. on the 15th prior to the scheduled publication.
If the Advertiser or Agency fails to give notice by the noted deadline, Midwest Nest Magazine reserves the right to charge the
contracted, original amount due.

COLLECTION POLICY/TERMS
Total payment due with contract for one-time ads. Multiple-run ads will be billed and invoice is due on receipt. No one-time ads will be printed without payment in full in advance. Any contract changes are subject to rate penalties. In the event it becomes necessary for Midwest Nest Magazine, at its option, to place this agreement in the hands of an attorney or collection agency for purposes of debt collection, the Advertiser agrees to pay an additional sum equal to 33% of the balance then due to compensate Midwest Nest Magazine for cost of collection, including but not limited to, reasonable attorney’s fees or collection agent’s fees. All checks for deposit or payments shall be made to Midwest Nest Magazine. A $30 service charge will be imposed on any check returned for any reason.
A finance charge of 1% per month may be imposed on accounts 60 days or more overdue beyond applicable In-Home date.

PRODUCTION REQUIREMENTS
Electronic files will be accepted via email in Quark-Mac, Acrobat PDF, TIFF and/or JPEG format or on CDs or ZIP drives. All electronic
files must adhere to the advertising dimensions and specifications as shown on the Specifications Sheet. Proof color requirements
must be converted to CMYK prior to submitting.

CONVERSIONS/ALTERATIONS
Advertisers sending less different than as listed in Production Requirements, may be charged an hourly fee for conversion to a usable format. If a client submits artwork in dimensions that are not listed on the Specifications Sheet, and it is after the specified deadline, Midwest Nest Magazine reserves the right to reduce or enlarge the ad without client approval.
The inclusion of the advertiser’s advertisement in this magazine shall not constitute an endorsement of the advertiser or the advertiser’s product or service, and this magazine shall contain such a disclaimer.
The advertiser assumes full and complete responsibility and liability for the contents of all advertising copy or artwork submitted, printed, and published pursuant to this agreement, and the advertiser shall indemnify and hold Midwest Nest Magazine harmless against any demands, claims, or liability.

ARTWORK/PLACEMENT ERRORS
If a booked Advertisement is not published at all solely due to a mistake on Midwest Nest Magazine’s part, The Publisher will try to offer an alternative publication date(s). If the alternative date(s) is not accepted, the original booking will be cancelled and the Advertiser shall be entitled to a full refund if the Advertiser has paid in advance for the Advertisement. This shall be the Advertiser’s sole remedy for failure to publish the advertisement.
If the Advertisement as reproduced by Midwest Nest Magazine contains a substantial error solely due to a mistake on Midwest Nest Magazine’s part, Midwest Nest Magazine shall, on request, re-publish the Advertisement at no additional cost to the Advertiser. Midwest Nest Magazine shall not be responsible for repetition of errors and it is the Advertiser’s responsibility to inform The Publisher of any errors and provide any necessary assistance to Midwest Nest Magazine to prevent a repeat of the error.
Midwest Nest Magazine shall not be responsible, under any circumstances, for any loss of profit, loss of opportunity, loss of goodwill, loss of anticipated saving, loss of revenue and/or any other loss which happens as a side effect of the main loss suffered by the Advertiser or any loss which could not be contemplated by Midwest Nest Magazine and the Advertiser, and The Publisher’s maximum total liability for any loss or damage arising out of or in relation to any Advertisement whether in contract, tort or otherwise shall not exceed the total amount of the charges for the relevant Advertisement actually paid by or on behalf of the Advertiser.

ACCEPTANCE
Submission of any advertisement, insertion order, space reservation or position commitment constitutes acceptance of all the foregoing general conditions.
By entering into an advertising contract with Midwest Nest Magazine, the Advertiser acknowledges that their representative understands and will abide by Midwest Nest's 2020-21 terms and conditions, as stated.
